Although the Firefighters have won their case, the courts have always been clear that the government is empowered to change pensions; this case concerned the transitional arrangements that were put in place for those transferring/not transferring, and whether they were fair to both. Each public sector pension scheme put in place different transitional arrangements; it does not therefore follow that those for the Armed Forces, which were significantly different from those of the firefighters were also unfair.
We are examining the detail of the judgement to see whether there is any read-across to the Forces. At this stage we are not convinced that there is, but are taking further advice in the light of the judgement and the government’s response to it.
