On 29 January 2026, the Ministry of Defence (MOD) was refused permission by an Employment Appeal Tribunal to challenge the Milroy decision. In late March, the MOD submitted a further application to the Court of Session seeking permission to appeal.
The Court of Session will now decide whether it will consider the case. This decision could take anywhere from a few weeks to up to six months.
